for Memberships, Contracts and Payment

TERMS & CONDITIONS

CLIENT MEMBERSHIPS

Access
Membership subscribers are entitled to use the facilities with in the studio from the hours of 430 am to 10 pm 7 days per week. This doesn’t include; Infrared Sauna, Evolt scanner, Café; these items are to be booked in and are a paid service out side of the membership.
Members will be issed a swipe card to gain access . This is charged at a cost of $30 per card. Each visit members are required to swipe in at the main entrance door prior to entry.
Only the member under the membership are to use the facility and gain access via the swipe card. Members allowing non members to have access will incur a $200 fine. This will be automatically deducted from the members account. From this a warning will be issued to the member about the breach. If 2 notifications are given the membership will be suspended at the discression of the Studio Manager.

Membership start dates.
Memberships will be activated on the date of request, providing the required forms have been completed. Forms are; Contract membership form, Stripe direct debit setup, Studio consultation form.

Suspending Memberships
Memberships may be suspended for a period no less than 14 days for Weekly gym access. Memberships can be held for a max of 4 weeks per 12 months. Memberships are to be requested for suspension/hold in writing to Re-bootfitness@outlook.com
Three month memberships are not applicable to suspension or holds.

Membership termination
This is an on going membership agreement.will continue until either you or the supplier terminates it in the way described in the agreement. If an automatic debit arrangements in place.membership fees will continue to be in place and direct debits will continue to occur. To stop this notification will need to be placed in writing and sent to the manager of Re-boot fitness.
If you choose to stop the auto debits out side of the contract agreement you will be held for breach of contract.
Termination of membership agreement must be in writing and can only occur as per the following.
You may terminate your membership with in 48 hours of the joining date, should you feel the studio doesn’t meet you expectations and your circumstances have changed, this forms your cooling off period. During this time you are entitled to a full refund minus the cost of using the facility during this 48 hours. Each of these sessions will be charged at the casual non member casual rate.
After the cooling off period you may terminate your membership. You will incur breach of contract charge for period left – 50% charge total contract period still due. Following the 12,6,3 month time frames.
Termination may occur if breach of agreement is evident. This is at the discression of the Studio manager.
Fees and collection.
Fixed term memberships/contracts are to be paid as per the following
Weekly through stripe (small group pt only)
Fortnightly through stripe (small group pt only)
Month by month through stripe.
Full payment by Cash, merchant device(efpos) or bank transfer
Fees will be charged ongoing as per the agreed periodic time frame set by the start date.
A dishonour fee of 10% will be charged for every attempt of the transaction amount.

Personal Trainers
Personal trainers not in contract to re-boot fitness are not allowed to be training other members. The personal trainers in contract/employment with Re-Boot Fitness recieve professional guidence and invest in further education. Thisis thier lively hood and respect is to be given.

Membership Transfers
Your membership is not to be transfered to another person unless approved by the manager. Memberships are a personal agreement to you and Re-Boot Fitness.

Completion of Consultation Documentation.
No person will be provided irrespective if they are a casual visitor or they enter an membership agreement unless they have completed the online / Paper consultation forms. These detail the consumers potential risk of participatingin a fitness or exercise service.
Where answers to the questions indicate that a consumer may be at risk from participating in a particual fitness service, Re-Boot Fitness will not supply any unsupervised fitness service to the consumer. The consumer has to provide medical documemntation outlining what is and is not acceptable from a health profesional/ Medical Practitioner.
Where Re-Boot Fitness recieves evidence that the consumer may be at risk from participating in an exersice activity, no fitness service will be provided untill an appropriately qualified persona has provided advice to the consumer in relation to an appropriate fitness program.

Safety to you and others.
Re-Boot Fitness is a extended hours studio/gym. $30 am to 10 pm, 7 days per week. The studio/gym only has direct supervision as per the manned hours.
For the safety of others and property inside the club 24 hour CCTV surveillance is recorded live.
in the event of an emergence please follow Emergency Procedure through out the studio/gym.
Members are not allowed to enter into the studio/gym under the influence of achole and or illicit drugs and/or medication that states strenuous activity to be avoided on its warning label.
All members are to respect the property of others and of Re-Boot Fitness and willbe held liable for any damages caused.

Persoanl Privacy
All personal information collected is in the strictest confidence that is shall be securely safe guarded.
Re-Boot Fitness will not disclose to any person any personal information acquired, to another member unless written approval is given.
All Members give permission to Re-Boot Fitness for thier photo to be taken and stored.

Membership Fee Increase
We reserve the right at any time increase membership fees. During this time 14 days written notification is to be given to all members effected by the membership change. notification will be advised through the information collected during the consultation. Following such notice you authorise us to increase any direct debits to your credit/debit accounts which you have authorised upon joining.

Risk Management
To mitigate risk and ensure that you correctly opperate or use our facility, services, products, or equipment, including any adjustments of levels or settings on any equipment you are required to undertake an instructional consultation. This service is booked as a personal training session and charged at the trainers rates.

Responsibility for Damage
You are soley responsible for any damage which you may cause to Re-Boot Fitness , its facility, services,products or equipment, if such damage is caused by your wilful act and /or negligence.

Damages/Personal Injury
WARNING – while training in Re-Boot Fitness you may suffer injuries including broken bones, soft tissue injuries and joint injuries. Any injuries suffered by you may occure as a result of weights striking you, collision with equipment or other membersor as a result of you slipping on the floor wet and/or dry.

Acknowledgements
I ACKNOWLEDGE that the activity I have voluntarily agreed to undertake with RE-BOOT FITNESS is a dangerous activity and that by participating in it I am exposed to certain risks.
The activity includes, fitness classes incorporating cardio vascular exercise, strength and conditioning training, resistance training, weight lifting, Fit boxing and other programmes, personal training sessions, training activities undertaken both on and off the premises, participation in team or individual competitions, and other services provided to the participant by RE-BOOT FITNESS.
I ACKNOWLEDGE AND UNDERSTAND that whilst participating in such activity with RE-BOOT FITNESS: • I may be injured, physically, emotionally or mentally, or may die.
• My personal property may be lost or damaged.
• Other persons participating in such activity may cause me injury or may damage my property.
• I may cause injury to other persons or damage their property.
• The conditions in which the activity is conducted may vary without warning.
• I may be injured or die or suffer damage to my property as a result of negligence or breach of contract by RE-BOOT FITNESS.
• There may be no or inadequate facilities for treatment or transport of me if I am injured.
• I assume the risk and responsibility for any injury, death or property damage resulting from my participation in the activity.
I FURTHER ACKNOWLEDGE AND UNDERSTAND that whilst participating in such activity with RE-BOOT FITNESS:
• I will follow the safety advice, training directions and exercise instructions of RE-BOOT FITNESS trainers, contractors, and volunteers.
• If I feel unwell during training or feel pain and/or discomfort, I will cease participating and immediately advise a RE-BOOT FITNESS trainer.
• If, for any reason, I require first aid or medical assistance, I authorise RE-BOOT FITNESS to seek emergency medical assistance on my behalf with the understanding that I am responsible for all costs incurred.

RELEASE OF LIABILITY AND INDEMNITY TO RE-BOOT FITNESS
IN CONSIDERATION of the acceptance of my payment for participating in the activity (and except to the extent that the same may be precluded by Law) I AGREE TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against RE-BOOT FITNESS its directors, owners, employees, trainers, and contractors, notwithstanding that such claims may arise due to Negligence, breach of contract, or breach of statutory duty. FURTHER;
• I participate in the activity at my sole risk and responsibility.
• I release, indemnify and hold harmless RE-BOOT FITNESS, directors, owners, employees, trainers, and contractors, from and against all and any actions or claims which may be made by me, or on my behalf by other parties, arising out of any injury, loss, damage or death caused to me or my personal property whether by negligence, breach of contract or in any other way whatsoever.
I ALSO AGREE THAT in the event that I am injured or my personal property is damaged, I will bring no claim, legal or otherwise against RE-BOOT FITNESS in respect of that injury or damage. This agreement shall be effective and binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.

SMALL GROUP PERSONAL TRAINING.

Terms & Conditions – Small Group Personal Training Sessions
1. Waiver
· I agree to sign a waiver upon commencing with Re-Boot Fitness

2. Minimum Age
· The minimum age is 15 years old for all Small Group Personal Training Sessions fitness If I am under 18 years of age, a letter from a parent or guardian authorising me to train, will be submitted upon registration.

3. Physical Condition
· I understand the demanding physical nature of this I am not aware of any medical condition, injury or impairment that will be detrimental to my health if I participate in this activity. In the event that I become aware of any medical condition, injury or impairment that may be detrimental to my health if I participate in my activity, my trainer will be immediately informed. By continuing to participate in this activity, I accept the risks despite these conditions and am still, and will always be under the terms of this agreement.
· I acknowledge that it is a condition of participating in this activity and that I do so at my own
I accept all risks and hereby indemnify and release the trainer, their agents, affiliates, employees, members, sponsors, promoters and any person or body directly and indirectly associated with the Trainer, against all liability (including liability for their negligence and the negligence of others), claims, demands, and proceeding arising out of or connected with my Small Group Personal Training Sessions.
· This release and indemnity continues forever and binds my heirs, successors, executors, personal representatives.

4. My Responsibility
· I accept that it is my responsibility to ensure I follow the Trainer’s instructions at all times and follow safe and correct use of all equipment provided, to ensure my own safety and the safety of others around the studio.
· I agree to inform my Trainer immediately of any pain, discomfort or injury to avoid further pain, discomfort or injury.
· I agree to always attend my training sessions in proper training attire.
· I agree to bring a sweat towel and water bottle to each and every training session.
· I agree to wear hands wraps to all Cardio Boxing (these can be purchased from Re-Boot Fitness)
· I agree to bring my Asthma pump with me to all training sessions, if I am an Asthma sufferer.

5. Payment
· I will ensure that adequate funds will be available in my nominated bank or credit card account to cover my prescribed training I understand there will be a $15.00 dishonor fee for any rejected payments and that my training will be suspended until all outstanding dues are paid in full. I also understand that debt collection will be initiated if fees are not paid within 21 days of becoming outstanding.
6. Auto-Pay Fees
· I understand that an administration fee of $2.50, charged for account set-up for weekly schedules on our System Stripe. This will be added to the weekly amount.
7. Auto-Pays (Direct Debit)
· I accept that payments will be deducted fortnightly from my account if I have purchased a fortnightly contract, and lump sum for a purchased lump sum payment

8. Direct Debit
· I accept that Re-Boot Fitness does not accept any other payment method besides STRIPE via No Cash, No Cheque, No Bank Transfer, No Eftpos, No other method.

9. Make-Up Classes
· I accept that I will need to make up any classes scheduled on public holidays as there is no training on public
· Make-Up classes will be offered by Owner to ensure physical activity options are available. These are as per the current standard Re-Boot Fitness time table.

10. 100% Satisfaction Money Back Guarantee
· I agree to notify Re-Boot Fitness in writing, if I am not seeing any results I will be able to receive 100% money back guarantee, excluding any administration or auto-pay transaction already completed. This will be reviewed in a sit-down discussion looking over results.

11. Fee Increases
· I understand that Re-Boot Fitness reserves the right to increase fees at any stage, only after the completion of my current contract, and that Re-Boot Fitness will provide me with 14 days’ notice if this occurs.

12. Terms & Conditions
· I accept that Re-Boot Fitness has the right to amend the Terms & Conditions as required and will give me 14 days’ notice if this occurs.

13. Cancelation
· I accept that I have signed up for a Small Group Personal Training Sessions contract and that any cancelation to this contract forfeits me of any refund on sums already paid. If cancelation is required 30 days notice is to be given in writing. At this point in time the full amount will be charged and access granted continuing for the 30 days.
· I accept that cancelations and refunds are at the discretion of the Owner of Re-Boot Fitness.

14. Medical Certificates
· I accept that I will forfeit all monies paid and to be paid if unable to continue with the Small Group Personal Training Sessions. This is set even if a medical certificate is presented. Meeting with train will be undertaken to modify program to achieve goals given restrictions.

15. Auto-Renewals
· Not applicable – Membership is ongoing to cancelation notification 30 days policy.

16. Series of Sessions
I acknowledge that I am signing up for a particular series of sessions and that the selected sessions will be my standard sessions for each week of the Small Group Personal Training Sessions, unless I reschedule within the prescribed time. Or discuss with Trainer.
· I also acknowledge that I will be automatically scheduled for the same sessins upon the automatic renewal.
17. Sessions
· I accept that any free sessions that I have been eligible to receive, can only be used subject to availability of space in any particular sessions and that I cannot obtain a cash refund or credit if I do not use the free session/class.
· I accept that free sessions are not designed as per the missed sessions in the Small Group Personal Training Sessions.
· I accept that I cannot carry over free or unused sessions from one week to the next; all sessions must be used during the contract period in which they have been designed week by week.

18. Media and Marketing, photo authorisation release
· I accept that Re-Boot Fitness takes photos and videos during classes for marketing and promotional purposes and that my image may be included in these photos and I understand that this does not include my profile photo taken at Orientation, and that my profile photo is private and confidential and will in no way be used without my prior written consent.

19. Definitions
· I understand for the purposes of this contract the terms ‘Trainer’ and ‘Coach’ are one and the same.

Please note all phone call bookings are to be paid in full over the phone via the Murchant device or through pay now on setmore at the time the client is making the booking.

This step has been taken to ensure all clients are treated with the same level of service.

These services include Sauna, Evolt scanner, Personal Training, Macro Consults and Classes.

Sunday books are to be paid up front at all times. These services are including all services supplied by Re-Boot Fitness.

**HOLD POLICY**

Please note all memberships held under the Re-Boot Fitness name are to fall under the Membership HOLD POLICY.

This policy requires the clients in a membership to give 14 days’ notice to HOLD their membership. At this point in time notification requires “The HOLD Membership Form” to be filled out by the client.

All clients on Memberships will be required to complete the Membership HOLD Form. From the time of the form being filled out the membership 14 days will commence.

Memberships can not be held for any time periods less than 14 days inclusive.

Memberships can only be held for a period of 5 weeks or more per year per client.

All clients moving from a 6, 8, 12 weeks set timed program (challenge) and wish to continue with the listed services will automatically fall under the Membership HOLD Policy.

No membership can be placed on HOLD during a Cancellation Period.

**LONG TERM HOLD POLICY**

Please note all memberships held under the Re-Boot Fitness name are to fall under the Membership LONG TERM HOLD POLICY.

LONG TERM HOLD MEMBERSHIPS are for clients needing memberships held for 2 months or more. For this to occur clients will be required to issue another DEBIT/CREDIT card valid past the hold date. This will be securely entered into STRIPE. If the client doesn’t contact Re-Boot Fitness after the extended hold period or respond to the contact tried by Re-Boot Fitness staff. The 30-day cancellation policy becomes active. If by chance the client is resuming same membership after the 30-day cancellation period, a full refund of the 30-day cancellation period will be honored.

This policy requires the clients in a membership to give 14 days’ notice to LONG TERM HOLD their membership. At this point in time notification requires “The LONG-TERM HOLD Membership Form” to be filled out by the client.

All clients on Memberships will be required to complete the Membership LONG TERM HOLD Form. From the time of the form being filled out the membership 14 days will commence.

Memberships cannot be held for any time periods less than 14 days inclusive.

All clients moving from a 6, 8, 12 weeks set timed program (challenge) and wish to continue with the listed services will automatically fall under the Membership LONG TERM HOLD Policy.

No membership can be placed on LONG TERM HOLD during a Cancellation Period.

This policy is to ensure all clients are treated equal and a set standard is achieved across the board for all Re-Boot Fitness Members.

**30-DAY CANCELLATION POLICY**

Hello CLients, Please read the following policy. This policy is structured to ensure all clients of re-boot fitness are treated equally.

30 day cancellation notification period

Please note all memberships held under the Re-Boot Fitness name are to fall under the Membership 30-DAY CANCELLATION POLICY.

Services

ALL MEMBERSHIPS HELD UNDER THE RE-BOOT FITNESS NAME.

1. Sauna Membership.

2. Evolt 360 Body Scan Membership.

3. Small Group Personal Training Memberships.

4. Mums and Bub Membership.

5. Weekly Membership.

6. Class Membership.

A holistic approach to sustainable health and fitness.

Please note all memberships held under the Re-Boot Fitness name are to fall under the 30-day cancellation notification period POLICY.

This policy requires the clients in a membership to give 30 days’ notice to cancel their membership. At this point in time notification requires “The Cancellation Form” to be filled out by the client.

From this point the client will have the 30 days payment removed at one lump sum of what their Current Membership.

Memberships are not allowed to be reduced to lesser valued memberships 30 days before the Membership Cancellation Form is completed.

All clients on Memberships will be required to complete the Cancellation Form. From the time of the form being filled out the membership 30 days will commence.

All clients moving from a 6, 8, 12 weeks set timed program (challenge) and wish to continue with the listed services will automatically fall under the 30-day Cancellation Policy.

No membership can be placed on hold during a Cancellation Period.
